General rental terms and conditions
RENTAL AGREEMENT
Dear Sir or Madam,
We are pleased to offer you the reservation of our gîte under the conditions described in this document.
The owners
- The gîte is non-smoking. Pets are not allowed.
- The owners must be informed of any access to the gîte by third parties.
I, the undersigned, ………….. declare that I agree to the terms of the contract after having read and initialled the general conditions attached to this document.

GENERAL CONDITIONS
Article 1:
This contract concerns the rental of the gîte ………… located at 1103 chemin de la Papeterie, 26790 TULETTE.

A shared swimming pool is available on the property, during the season, between 10:00 am and 7:00 pm.
Article 2 – duration of stay:
The tenant signing this contract for a fixed period may under no circumstances claim any right to remain in the premises after the end of the stay.

Article 3 – conclusion of the contract:
The booking becomes effective once the tenant has sent the owner the deposit indicated on the front of this document, together with one signed copy of the contract before the indicated date. A second copy must be kept by the tenant.

The rental concluded between the parties under this agreement may under no circumstances benefit, even partially, third parties, whether natural persons or legal entities, unless with the owner’s written consent. Any breach of this provision may result in the immediate termination of the rental at the tenant’s expense, with the rental amount remaining permanently acquired by the owner.
Article 4 – cancellation by the tenant:
Any cancellation must be notified to the owner, with acknowledgment of receipt.
a) cancellation before arrival at the premises:
the deposit remains acquired by the owner. The owner may request payment of the balance of the stay if the cancellation occurs less than 30 days before the scheduled arrival date.
If the tenant does not appear within 24 hours following the arrival date stated in the contract, this contract becomes null and void and the owner may dispose of the gîte. The deposit also remains acquired by the owner, who will request payment of the rental balance.
b) if the stay is shortened:
the rental price remains acquired by the owner. No refund will be made.
Article 5 – cancellation by the owner:
The owner refunds the tenant all sums paid in advance.
Article 6 – arrival :
The tenant must arrive on the specified day within the time slot mentioned in this contract. In the event of a late or delayed arrival, the tenant must notify the owner.
Article 7 – payment of the balance:
The balance of the rental is paid 1 month before the start of the stay.
Article 8 – inventory and condition report :
An inventory is drawn up jointly and signed by the tenant and the owner or the owner’s representative on arrival and departure from the gîte. This inventory is the only reference in the event of a dispute regarding the condition of the premises. The cleanliness of the gîte upon the tenant’s arrival must be recorded in the inventory. Cleaning under normal use is the responsibility of the owner. In the event of abnormal use of the premises, or exceptional dirtiness, the amount of the costs will be deducted from the tenant’s security deposit.
Article 9 – security deposit :
Upon the tenant’s arrival, a security deposit in the amount indicated on the front of this contract is requested by the owner. After the joint check-out inventory has been completed, this deposit is returned, less the cost of restoring the premises if any damage is found.
In the event of an early departure (before the time indicated in this contract) preventing the check-out inventory from being carried out on the same day of the tenant’s departure, the security deposit is returned by the owner within a period not exceeding one week.
Article 10 – use of the premises :
The tenant must ensure the peaceful nature of the rental and use it in accordance with the intended purpose of the premises.
Article 11 – capacity:
This contract is drawn up for a maximum occupancy capacity. If the number of tenants exceeds the accommodation capacity, the owner may refuse the additional persons. Any modification or breach of contract will be considered to be at the client’s initiative.
Article 12 – animals :
This contract states whether or not the tenant may stay accompanied by a domestic animal. In the event of non-compliance with this clause by the tenant, the owner may refuse the stay. In this case, no refund will be made.
Article 13 – insurance:
The tenant is responsible for all damage arising from their actions. The tenant must be insured.
Article 14 – payment of utilities :
Water and electricity charges are included in the rental price, for normal use. In the event of abnormal use, these charges may be re-invoiced to the tenant.
Article 15 – disputes:
Any claim relating to the rental will be handled by the competent court.
